MIKE PORTNOY Says He Is \'Legally Not Allowed\' To Comment On DREAM THEATER Lawsuit Ex-DREAM THEATER drummer Mike Portnoy has commented on the report that he filed a lawsuit against his former bandmates in April claiming that they "wrongfully excluded" him from the group and are "wrongfully using the name of the band in connection with [their] recording of an album without the participation or consent of [Portnoy]." The drummer's complaint, which was filed on April 27, alleges that the defendants — John Petrucci (guitar), John Myung (bass), Jordan Rudess (keyboards), James LaBrie (vocals), along with associated companies Ytse Jam, Inc. and Infinity Tours, Inc. — "are wrongfully using the name of the band in connection with the promotion of live performances by the individual defendants, without the participation or consent of [Portnoy]."
Writing on his official forum after the news broke earlier today, Portnoy said, "Everyone needs to chill out. Stop feeding into this negative poison on the net... I am legally NOT ALLOWED to speak of business matters, but I'm sure you realize there are two sides to every coin... If I could openly talk about this stuff and expalin the REALITY of everything, I would love nothing more!!! But I am legally unable to discuss it... In the meantime, life is bright and positive...I am happy and so are they....so shouldn't YOU be too??? Don't believe the hype...Carpe Diem!"
Portnoy, who co-founded DREAM THEATER more than 20 years ago, announced his departure from the band in September 2010 while on tour with AVENGED SEVENFOLD. He has since been replaced by Mike Mangini (ANNIHILATOR, EXTREME, JAMES LABRIE, STEVE VAI).

AUTUMN To Release \'Cold Comfort\' In NovemberDutch heavy rock collective AUTUMN will release its fifth full-length album, "Cold Comfort", on November 7 in Europe via Metal Blade Records. According to a press release, the CD "offers a collection of striking songs blended into a diverse and yet surprisingly compact album, one that AUTUMN considers to be their most personal and meaningful to date. While AUTUMN's roots remain firmly planted in heavy rock/guitar-oriented soil, their branches are stretching out to more progressive musical genres and alternative approaches to the sound of individual songs."
Commented guitarist Jens van der Valk: "In terms of sound, we realized there were still leaps to be taken out of our comfort zone and into unthought-of possibilities. As a first step in the right direction, our main focus was on a more open, transparent sound, one through which the often multi-layered nature of our songs would be optimally channeled."
AUTUMN needed not look far for a man to put at the helm with the right pioneering philosophy for the band to begin taking leaps: Erik-Jan Dodd, AUTUMN's live sound engineer since the 'My New Time' era, envisioned a more vintage approach for 'Cold Comfort'. An experiment the band was all too eager to embrace, explains guitarist Mats van der Valk. "If there's anyone who knows what we're all about and more importantly: what we could potentially be all about, it's E-J."
"Cold Comfort" will be released as a limited first edition digipak CD including two bonus tracks.

TESTAMENT Guitarist On New Album: \'It\'s Looking Like We May Have A Winner\'San Francisco Bay Area thrashers TESTAMENT have been spending time in the studio recording their new album, "Dark Roots Of Earth", tentatively due in February 2012 via Nuclear Blast Records.
Due to a "serious injury," regular TESTAMENT drummer Paul Bostaph was unable to take part in the recording sessions for the CD. Playing drums on the follow-up to 2008's "The Formation Of Damnation" is Gene "The Atomic Clock" Hoglan (ex-DARK ANGEL, ex-STRAPPING YOUNG LAD, FEAR FACTORY, DETHKLOK), with LAMB OF GOD's Chris Adler set to make a special guest appearance on a couple of bonus tracks.
Commented TESTAMENT guitarist Alex Skolnick: "We're more than halfway done recording the new album, 'Dark Roots of Earth'. It's coming along as well or better than any album this band has done. It just seems to have a focus, clarity and definition on a level that I don't remember at this point in the process. Of course, you can never truly sum up an album until all the tracks are recorded, the mixes are done and the entire collection is mastered. But from where things stand right now, it's looking like we may have a winner."

COAL CHAMBER - Reunion?Wie der ehemalige COAL CHAMBER- und jetzige DEVILDRIVER-Fronter Dez Fafara nun in einem Interview mitteilte, schließt er momentan eine COAL CHAMBER-Reunion nicht generell aus. Fafara hatte die Band wegen anhaltender interner Probleme und der Drogenabhängigkeit mehrerer Bandmembers im Jahre 2003 aufgelöst. Das scheint nun Schnee von gestern zu sein.

"Wir haben die Vergangenheit hinter uns gelassen. Wir sind seit Jahren gute Freunde - sie kommen zu DEVILDRIVER-Shows. Ich weiß momentan noch nicht, ob ich eine Reunion in Betracht ziehe, aber ich würde einige Shows zusammen absolvieren. Definitiv."

WITHIN TEMPTATION Guitarist To Step Down From Touring DutiesVocalist Sharon den Adel and guitarist Robert Westerholt of Dutch symphonic metallers WITHIN TEMPTATION have released the following statement:
"As you know, in recent years we were blessed with the birth of three children. Since then not only our kids but also WITHIN TEMPTATION has been growing fast and we are touring in more countries than ever before.
"To be able to fulfill the needs of our children but just as much the needs of the band for now and also in the future, we decided Robert will step down from touring live, (except for the occasional show). With this change we can give stability to our children and from the home studio Robert will have more time writing new music and developing new creative ideas for the live show, the comic and future movies.
"What makes the decision easier is the fact that Stefan Helleblad is willing to take Robert's place in the band on stage. Stefan has been working with the band behind the scenes for some years. As a sound engineer he was involved in the production of our latest three records. Next to being a great sound engineer, mixing engineer and producer he is also a very gifted guitar player. On our latest album, 'The Unforgiving', you can already hear him play some special guitar parts. His first show will be on [September] 21st in Heerhugowaard.
"So this is not a goodbye but a new step, or actually two steps in a very exciting new and inspiring time for our band.

VOIVOD\'s 1984 Demo To Be Released On CD, VinylCanadian metal innovators VOIVOD will release their original demo tape from 1984.
Entitled "To the Death 84", the set will include material that was recorded in the band's Quebec jam space in January 1984. The lineup for this record includes Snake (Denis Bélanger) on vocals, Piggy (Denis D'Amour) on guitar, Blacky (Jean-Yves Thériault) on bass and Away (Michel Langevin) on drums.
In addition to material that would later appear on the band's "War And Pain" debut, this collection includes several other early VOIVOD offerings, as well as covers of MERCYFUL FATE and VENOM.
"To The Death 1984" will be released on November 22 as a CD or double LP via Alternative Tentacles.

TOXIC HOLOCAUST Releases Benefit Split 7\" With MIDNIGHTPortland, Oregon metal-punk warriors TOXIC HOLOCAUST have teamed up with Cleveland's MIDNIGHT for a split seven-inch single to benefit Japanese victims of the tsunami disaster.
The single is limited to a one-time pressing of 1,000 copies on Japanese-flag-colored heavyeight vinyl, and features tracks from both bands ("A.T.O.M.I.C." by TOXIC HOLOCAUST, "Destroy Tsunami's Power" by MIDNIGHT) exclusive to this release. The split also features exclusive artwork by Daniel "Sawblade" Shaw (TOXIC HOLOCAUST, INSECT WARFARE, COFFINS). All proceeds will go to the Red Cross relief efforts for victims of the tsunami disaster.
TOXIC HOLOCAUST's new album, "Conjure And Command", is out now internationally and available on a variety of formats, including a limited-edition deluxe CD and DVD set that includes a full TOXIC HOLOCAUST live set.

September das neue Album von SVBWAY TO SALLY erscheint, dann bedeutet das nicht nur zwölf neue Songs, sondern zugleich auch die musikalische Wiedervereinigung von Moderne und Tradition, von Ost und West, von Rock und Mittelalter – und überhaupt von allem, was eigentlich gar kein Gegensatz sein sollte. Womit das Album, obwohl es auf den Titel „Schwarz In Schwarz“ hört, eines der farbenfrohsten ist, das die deutsche Musiklandschaft seit langem hervorgezaubert hat.
„Schwarz In Schwarz“ ist das bereits 16. Studioalbum einer Band, die trotz hoher Charteinstiege und kommerzieller Erfolge stets dem Independant, der Schwarzen Szene, treu geblieben ist. Als Individualisten haben sich die Potsdamer im Laufe ihrer nunmehr fast 20jährigen Karriere immer für das musikalisch Feingeistige und wider die Kommerzialisierung entschieden. Und damit auch für eine Zusammenarbeit mit der CAPELLA ANTIQUA BAMBERGENSIS, einer einzigartigen Formation, die Originalstücke aus dem Mittelalter rekonstruiert, aufführt und dafür sogar Instrumente selbst nachbaut – so originalgetreu wie es Fundstücke aus dem Mittelalter nur zulassen.
„Wir lieben das Handgemachte in der Musik“, sagt Schlagzeuger Simon Michael. „Wir haben auf dem aktuellen Album daher sogar Drumloops durch echt gespielte Percussion ersetzt.“ Eine Einstellung, die mit der der CAPELLA ANTIQUA von Anfang an harmonierte – überhaupt fanden sich zwischen den beiden Formationen unzählige Gemeinsamkeiten: beide Acts wurden 1992 als Folge eines lockeren Beisammensitzens von guten Freunden irgendwo in einer Privatwohnung gestartet – die einen im Osten, die anderen im Westen. Beide mit dem Ziel, ihr ganz eigenes Ding zu machen – die einen beeinflusst von der Musikszene des Ostens, die anderen geprägt von der westlichen Musiklandschaft.
„Wir sind ja ganz anders aufgewachsen im Osten“, so Gitarrist und Songwriter Bodenski. „Mit ganz anderen Musikacts, die so modern waren und mit ganz anderen Grundvoraussetzungen überhaupt frei Musik machen zu dürfen. Und trotzdem ist unser musikalisches Denken von Anfang der Zusammenarbeit an das genau gleiche gewesen, was mir wieder einmal zeigt, dass Grenzen und unterschiedliche Lebensbedingungen in der Musik überhaupt keine Rolle spielen. Entweder man fühlt sie oder eben nicht.“
Grenzenlosigkeit repräsentieren beide Bands auch, wenn es darum geht, fremden Musikinstrumenten gegenüber aufgeschlossen zu sein und fremde Melodien in die eigenen Stücke einfließen zu lassen. „Schon im Mittelalter war die Musik ein Schmelztiegel der Kulturen“, so Capella-Multiinstrumentalistin Anke Spindler. „Von jedem Kreuzzug kam Musik aus den anderen Kulturen mit nach Hause, heute reisen die Musiker auf der Suche nach den alten Melodien und Spieltechniken – in friedlicher Mission – in den Orient. Dort haben sich Instrumente und Spielweisen in mündlicher Überlieferung bis heute nämlich kaum verändert. Es ist also von je her eine gewisse Grenzenlosigkeit, die Musiker inspiriert und die Musik entstehen lässt.“
Auf „Schwarz In Schwarz“ hat die CAPELLA ANTIQUA BAMBERGENSIS für so manchen instrumentalischen Facettenreichtum gesorgt. Etliche Passagen wurden dabei im Schloss Wernsdorf bei Bamberg eingespielt, auf dem die Capella ihren musikalischen Sitz hat. “Die gemeinsamen Aufnahmen im Schloss waren richtig klasse. Wir haben dort ein Cembalo aufgenommen, das förmlich den Geist des Schlosses atmet. Das mag albern klingen, aber es geht beim Aufnehmen ja darum, die Magie des Momentes festzuhalten und das funktioniert an so inspirativen Orten wie dem Konzertsaal im Schloss quasi automatisch“, so Simon Michael.
Wenn am 23. September das Album „Schwarz In Schwarz“ in den Läden steht, werden die beiden Formationen diesen Anlass gemeinsam begießen – oder besser gesagt „begrillen“. „Wir werden den Feiertag am 3. Oktober dazu nutzen, uns einmal in gemütlicher Runde privat zusammenzufinden. Wir grillen gemeinsam und wer weiß, vielleicht entstehen aus der Liaison noch mehr spannende Projekte?“

In an August 2011 interview with the Greek edition of Rock Hard magazine, Portnoy stated about his departure from DREAM THEATER, "I didn't make the decision to leave DREAM THEATER before [hooking up with] AVENGED SEVENFOLD [as their touring drummer], but I knew that something had to change in the DREAM THEATER camp. It's unfortunate that it was me that had to change, because I never wanted to leave the band — it was never my intention; I never wanted the split. I just merely thought that the band really could use a break, because I think the romance was really dying — backstage and between [the members] personally. 25 years without a break is a very, very, very long time and sometimes these relationships need a break from each other to rekindle the flame. So that's all I suggested. And even before I [went on the road] with AVENGED SEVENFOLD, I remember touring with [the progressive rock project] TRANSATLANTIC at the beginning of 2010 and already knowing that something was wrong in the DREAM THEATER world and that I really needed a break from the guys and the whole DREAM THEATER machine. I knew something was brewing and I knew that I was unhappy, and as has been well documented elsewhere, I merely just wanted a break. But unfortunately, those guys [the rest of DREAM THEATER] didn't see it that way and didn't respect my request for time off. It's unfortunate [that it turned out that way]."

LIFELOVER Officially Disbands Following Mainman\'s DeathOn the night of September 9, Jonas Bergqvist (a.k.a. B) — the founding member, main composer, and guitarist of the Swedish "narcotic metal" band LIFELOVER — died unexpectedly. The cause of his death is still unclear and has yet to be established.
The remaining members of the group have since issued the following statement:
"On Friday morning, September 9th, B didn't wake up from his sleep. He didn't take his own life nor was he victim of any apparent action. The authorities in charge are still examining his body to find the exact cause of death.
"We, the remaining members of LIFELOVER, have decided to lay the band to rest. This would be the only right thing to do considering B was the main composer of LIFELOVER. Therefore, we won't be performing at our coming planned shows.
"We are very sorry and hope that all of the fans that had been looking forward to seeing LIFELOVER play live will understand.
"The concerts in Belgium and Holland were the last concerts of LIFELOVER.
"We want to thank everybody that was present and helped out, especially Rob 'Svograth' Polon of MONADS and the members of IXXI.
"These last days have been very hard for us and everybody that knew B.
"We want to thank all of our fans for being so respectful, dedicated and understanding and, most of all, for supporting LIFELOVER during all these years."

VAN HALEN Has Not Yet Signed With COLUMBIAAccording to the usually reliable unofficial VAN HALEN web site Van Halen News Desk, VAN HALEN has yet to officially ink a deal with Columbia despite rumors that the band had signed with the label after spending its entire 35-year career at Warner Bros. An "inside source" tells VHND.com that "there have indeed been serious talks between the parties, but that, as of today, there is no signed deal," reads a posting on the site.

MYSTIC PROPHECY: New Song Available For StreamingGreek/German heavy metallers MYSTIC PROPHECY will release their seventh album, "Raven Lord", on November 25 via Massacre Records. The CD was recorded at Prophecy Music Factory studios with singer/producer Roberto Dimitri Liapakis (MYSTIC PROPHECY, SUICIDAL ANGELS, VALLEY'S EVE, INSIDEAD) and was mixed by Fredrik Nordström (DIMMU BORGIR, ARCH ENEMY, IN FLAMES). The effort marks the recording debut of the band's new drummer, Claudio Sisto, who joined MYSTIC PROPHECY in June 2010. The artwork was created by Jonas Kawalek, who previously with the group on their fifth album, "Satanic Curses".

RAGNAROK Parts Ways With REGAIN RECORDS, Seeks New Label HomeNorwegian black metallers RAGNAROK have ended their collaboration with Regain Records and are currently seeking a new label home. Interested record companies can contact the band via their management at patriciathomas@btinternet.com.
Formed in 1994, RAGNAROK's latest album, "Collectors Of The King", was released in 2010 after a six-year hiatus, during which time RAGNAROK changed its lineup almost entirely, with drummer and founder member Jontho remaining the only original member. The group is rounded out by Hans Fyrste (vocals), DezeptiCunt (bass and backing vocals) and Bolverk (guitar).
